These conditions of carriage govern the services of flyvbird GmbH / VINI for flights on the Bern – Munich route. Set out here are the core provisions relevant to passengers; the complete version with all articles (1–14) is available at flyvini.com/de/general-conditions.
1. Contracting parties and applicability
flyvbird GmbH / VINI, Wolfschlugenerstrasse 7, 70597 Stuttgart, Germany. VAT ID DE327055484, Commercial Register HRB 789801, Local Court of Stuttgart.
These general conditions of carriage apply exclusively to air carriage services that are the subject of the contract of carriage. They apply accordingly in the case of a charter contract. They apply insofar as they are not in conflict with applicable law and public policy — in which case the law takes precedence.
2. Booking and payment
You can make bookings through the following channels: the website flyvini.com, travel agencies (including third-party websites) and the airport ticket counter.
Bookings are only considered confirmed once they have been recorded in the carrier's system. If payment is not made at the time of booking or by the communicated deadline, the booking will be cancelled.
Accepted payment methods: Visa, Mastercard, Maestro debit and credit cards as well as PayPal.
3. Fares and services
Basic. Small handbag (40×30×20 cm), free online check-in 24 hours before departure, changes in accordance with Article 3.3, non-refundable.
Classic. Small cabin bag (40×30×20 cm) and large cabin bag (55×40×20 cm), pre-assigned seat (except the first four rows and emergency exits), priority boarding, online check-in from 30 days before departure or at the airport, changes possible, non-refundable.
Biz. Additionally: 1 piece of checked baggage up to 32 kg, seat selection including front rows and emergency exits, large handbag (55×40×20 cm / 10 kg), priority boarding and priority online check-in, unlimited date/time changes free of charge, non-refundable.
4. Booking changes
Date and time changes are possible up to 3 hours before departure for a change fee per passenger and segment (except PSO fares).
Name changes are possible up to 30 minutes before departure for a change fee (except PSO fares).
Additional services can be added up to 30 minutes before departure; availability may be limited. Additional services are non-refundable.
5. Cancellation
In the event of a voluntary cancellation after completing the booking, the conditions of the respective fare selected apply. Cancellation requests must be submitted via the contact form on flyvini.com, no later than 3 hours before departure.
Basic and Classic fares are generally non-refundable. Taxes and airport charges may be refunded on request, insofar as legally permissible.
6. Check-in and boarding
Online check-in via flyvini.com or the VINI app:
- Basic fare: 24 hours to 3 hours before departure
- Classic, Biz fares and tickets with a pre-purchased seat: 30 days to 3 hours before departure
Airport check-in: opens 1 hour before departure and closes 20 minutes before departure. Boarding closes 10 minutes before departure. If online check-in is not completed up to 3 hours before departure, an airport check-in fee may be charged (except Classic/Biz).
7. Travel documents
Flights between Bern (Switzerland) and Munich (Germany) constitute international carriage. A valid passport or a recognised identity card (Swiss ID / German identity card) is required as a travel document. Digital copies are not accepted — originals are mandatory.
Passengers are themselves responsible for holding all required travel documents. If entry is refused, the passenger bears all associated costs; flyvbird / VINI is not liable.
8. Baggage
Hand baggage: 1 small piece (40×30×20 cm, max. 10 kg, under the seat) as well as, depending on the fare, 1 large piece (55×40×20 cm, max. 10 kg, overhead compartment). Additionally permitted are a coat, umbrella, walking aids, duty-free items and medication.
Checked baggage: standard 1 piece up to 23 kg (depending on the fare). Max. 4 pieces per passenger, individual pieces over 32 kg are not accepted. Prams for infants up to 5 years are transported free of charge.
Valuables such as cash, jewellery, electronics or identity documents should not be transported in checked baggage.
Damage reports must be submitted within 7 days of receipt (in the case of delay within 21 days); a PIR (Property Irregularity Report) is required.
9. Special assistance
Passengers with reduced mobility, unaccompanied minors and passengers requiring special assistance must inform flyvbird / VINI at the time of booking. For passengers with special assistance, check-in is required at least 2 hours before departure. Guide dogs for the blind are transported free of charge in the cabin upon appropriate documentation.
10. Animals in the cabin
Pets up to 10 kg (including the transport container) are permitted in the cabin, transport container max. 46×31×25 cm, waterproof and ventilated. Maximum 1 animal per passenger, 6 animals per flight. Guide and assistance dogs are carried free of charge upon certification.
11. Schedules, delays and cancellations
Published schedules may change. flyvbird / VINI takes all reasonable measures to carry passengers and baggage without delay. Times on tickets are not guaranteed and may change for operational, safety-related or regulatory reasons.
In the event of denied boarding, cancellation or a long delay, you have rights under EU Regulation 261/2004: care (meals, refreshments, accommodation where applicable), re-routing or refund, as well as compensation, provided no extraordinary circumstances apply.
For the Bern – Munich route (under 1,500 km), the compensation where entitled under EU 261/2004 is: €250.
Extraordinary circumstances — for which flyvbird / VINI is not liable — include in particular weather conditions, air traffic control restrictions, political instability, security risks and unexpected flight safety problems.
12. Refusal of carriage
flyvbird / VINI may refuse carriage if laws or regulations so require, if authorities so request, if you or your baggage pose a danger to the safety, health or peace on board, if you are intoxicated or under the influence of drugs, refuse security checks, have not paid the necessary fares/taxes, do not hold valid travel documents or breach these conditions. In such cases, the unused portion of the ticket may be refunded at discretion.
13. Responsibility for operational performance
The legally binding contract of carriage may be concluded with the operating air carrier where flyvbird / VINI acts as an intermediary and commercial agent. In this case, the "General Conditions of Carriage" of the respective air carrier apply to the operation of the flight. The respective air carrier is solely responsible for the operational performance and compliance with all aviation safety standards.
14. Refunds
Refunds are made in accordance with the rules of the fare purchased. Basic and Classic fares are generally non-refundable. Taxes and airport charges may be refunded if the passenger does not travel, insofar as legally permissible. Refunds are made exclusively to the person who purchased the ticket, using the same payment method.
Refund requests must be submitted via the customer assistance form on flyvini.com. Refunds are, where applicable, processed within 30 working days.
